These Terms of Service govern your use of Ducktastic.com and your purchase of products through our website.
By accessing or using the website or placing an order, you agree to these Terms, together with applicable policies referenced by these Terms.
If you do not agree with these Terms, please do not use the website or place an order.
1. About Ducktastic
Ducktastic is a Texas-based commercial food manufacturing business selling products directly to consumers.
Ducktastic is not a cottage food operation or cottage bakery.
Our food manufacturing operations are conducted under the applicable Texas regulatory and licensing requirements.
Our online sales are currently limited to customers within the lower 48 contiguous United States.
2. Use of the Website
You agree to use Ducktastic.com only for lawful purposes.
You may not:
- Use the website for fraudulent purposes;
- Attempt to gain unauthorized access to the website;
- Interfere with website operation;
- Introduce malicious software;
- Circumvent website security;
- Misrepresent your identity;
- Use another person’s account without authorization;
- Scrape or copy website content for unauthorized commercial purposes; or
- Violate applicable laws or regulations.
We may suspend or terminate access to the website when permitted by law if we reasonably believe these Terms have been violated.
3. Eligibility
You must be legally capable of entering into a binding agreement to place an order.
If you are under the age required to independently make a purchase under applicable law, a parent or legal guardian should place the order on your behalf.
4. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, ingredients, pricing, availability, and other website information are accurate.
However:
- Product photographs may be illustrative;
- Actual products may vary in appearance;
- Product availability may change;
- Packaging may change;
- Ingredients may change; and
- Website information may occasionally contain errors.
The product label and packaging provided with a product should be treated as the controlling source for current product-specific ingredient, allergen, storage, and handling information.
5. Food Safety & Allergens
Customers are responsible for reading applicable product labeling before consuming a product.
Follow all storage, handling, preparation, and date-marking instructions provided with the product.
Customers with food allergies or dietary restrictions should review the complete ingredient and allergen information before purchasing or consuming a product.
Federal law recognizes nine major food allergens: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, and sesame.
If you have a severe food allergy, contact Ducktastic before ordering if you have questions about a product.
Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.
6. Orders
When you place an order, you are submitting a request to purchase the products displayed in your cart at the applicable prices and terms.
An order confirmation acknowledges receipt of your order; it does not necessarily mean that Ducktastic has accepted every aspect of the order if an error, availability problem, fraud concern, or other legitimate issue is subsequently identified.
If we cannot fulfill an order, we will notify you and provide any refund required by applicable law.
7. Pricing
Prices are displayed in U.S. dollars.
Prices may change without notice before an order is placed.
Once an order has been successfully placed, the applicable purchase price shown at checkout generally applies to that order, subject to correction of obvious pricing errors and applicable law.
8. Sales Tax
Applicable sales tax is calculated through our WooCommerce tax system.
Ducktastic remains responsible for its applicable tax obligations.
The use of a tax-calculation service does not transfer Ducktastic’s legal tax responsibilities to WooCommerce or any other service provider.
9. Payment
Ducktastic currently uses Square for in-person payment processing and WooPayments for online payment processing.
Payment information necessary to complete a transaction may be transmitted to Square and/or WooPayments as applicable to completion of said sale.
Your payment may be subject to Square’s and/or WooPayments’ applicable terms and policies.
10. Production & Shipping
Food products are generally made to order.
Most food orders require approximately 7–10 days for production, and we recommend ordering at least 14 days before the date you need the products.
Shipping terms, carrier limitations, delivery areas, delays, and cancellation policies are described in our Shipping & Returns Policy, which is incorporated into these Terms.
11. Shipping Representations
Ducktastic makes reasonable efforts to provide accurate production and shipping estimates.
We will not intentionally advertise a shipping timeframe without a reasonable basis for believing that we can meet the represented timeframe.
If an order cannot be shipped within the applicable promised timeframe, Ducktastic will provide any delay notice, cancellation opportunity, or refund required by applicable law.
The FTC’s Mail, Internet, or Telephone Order Merchandise Rule applies to most Internet merchandise orders and requires sellers to have a reasonable basis for their shipping representations.
12. Cancellations
Orders may generally be canceled within 24 hours of placement for a full refund.
After 24 hours, production may have begun and a full refund may no longer be available.

Nothing in this provision limits any cancellation or refund right required by applicable law.
13. Returns
Food products generally cannot be returned after delivery because returned food cannot safely be placed back into inventory for resale.
This does not eliminate rights or remedies applicable to incorrect, defective, damaged, or otherwise nonconforming products.
Merchandise fulfilled through Printify may be subject to different return or replacement procedures.

14. Merchandise
Certain Ducktastic merchandise is produced through a print-on-demand fulfillment service.
Merchandise orders may therefore have different production, shipping, and return procedures than food orders.
Product-specific terms displayed at the time of purchase may also apply.
15. Intellectual Property
The Ducktastic name, logos, trademarks, product names, photographs, graphics, website design, written content, recipes, product descriptions, and other original materials are owned by or licensed to Ducktastic unless otherwise indicated.
You may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from proprietary Ducktastic materials without permission, except as permitted by law.
Nothing in these Terms transfers ownership of Ducktastic intellectual property to you.
16. Customer Reviews & User Content
If you submit a review, photograph, testimonial, comment, or other content to Ducktastic, you represent that:
- You have the right to submit the content;
- The content does not infringe another person’s rights;
- The content is not unlawful; and
- The content does not contain malicious software or harmful code.
By submitting content, you grant Ducktastic a non-exclusive, royalty-free license to use, reproduce, display, publish, and distribute the content in connection with our business and marketing, subject to applicable law.
We may decline to publish or remove content that is unlawful, defamatory, abusive, infringing, misleading, or otherwise inappropriate.
17. Promotions
Ducktastic may occasionally offer discounts, promotions, giveaways, or other special offers.
Additional terms may apply to specific promotions.
Those terms will control if they conflict with these general Terms.
18. Privacy
Your use of Ducktastic.com is also governed by our Privacy Policy.
Our Privacy Policy explains how we collect, use, and share personal information.
19. Third-Party Services
Ducktastic relies on third-party services to operate portions of the website and business.
These may include:
- Hostinger;
- WordPress;
- WooCommerce;
- WooPayments;
- WooCommerce Tax;
- ReachShip;
- Square;
- FedEx;
- Printify;
- Google Analytics;
- Google Ads; and
- Google reCAPTCHA.
Third-party services may have their own terms and privacy policies.
Ducktastic is not responsible for the independent policies or practices of third-party providers, except to the extent required by applicable law.
20. Website Availability
We make reasonable efforts to maintain the availability and functionality of Ducktastic.com.
However, we do not guarantee that the website will always be:
- Available;
- Uninterrupted;
- Error-free;
- Free of malicious code; or
- Compatible with every device or browser.
Website availability may be affected by maintenance, hosting problems, security incidents, software updates, or circumstances beyond our reasonable control.
21. Product & Website Disclaimers
To the fullest extent permitted by applicable law, information on Ducktastic.com is provided on an “as available” basis.
We do not provide medical, nutritional, legal, or other professional advice through the website.
Food-related information is provided for general informational purposes.
Product labels and packaging should be consulted for current product-specific information.
Nothing in these Terms excludes a warranty, right, remedy, or liability that cannot legally be excluded.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Ducktastic will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the website or purchase of products.
Nothing in these Terms:
- Excludes liability that cannot legally be excluded;
- Limits rights or remedies that cannot legally be limited;
- Waives consumer protections that cannot legally be waived; or
- Limits responsibility for conduct for which applicable law prohibits limitation.
23. Events Beyond Our Reasonable Control
Ducktastic will not be considered in breach of these Terms solely because performance is delayed by circumstances outside our reasonable control.
Examples may include:
- Severe weather;
- Natural disasters;
- Transportation disruptions;
- Carrier interruptions;
- Utility failures;
- Equipment failure;
- Supply shortages;
- Government action;
- Cybersecurity incidents;
- Labor disruptions; or
- Other circumstances beyond our reasonable control.
When such events affect an order, we will make reasonable efforts to communicate material delays and determine an appropriate resolution.
24. Governing Law
These Terms are governed by the laws applicable in the State of Texas, without regard to conflict-of-law principles, except to the extent that applicable law in a consumer’s state provides otherwise.
Nothing in this provision is intended to deprive a consumer of rights that cannot lawfully be waived.
25. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.
The remaining provisions will continue in effect.
26. No Waiver
If Ducktastic does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce the provision in the future.
27. Changes to These Terms
Ducktastic may update these Terms from time to time.
Updated Terms will be posted on the website with a revised “Last Updated” date.
Unless otherwise required by law, changes apply prospectively.
